Surrogacy in Georgia: A Safe and Well-Established Destination

Georgia has been one of the world’s leading surrogacy destinations since 1997, offering a clear legal framework, high-quality fertility care, and a straightforward parentage process for eligible intended parents.

Is Surrogacy Legal in Georgia?

Yes. Commercial gestational surrogacy has been legal in Georgia since 1997. The law allows heterosexual couples with a medical indication preventing pregnancy to build their family through surrogacy.

To be eligible, the couple does not have to be legally married. However, they must be able to prove that they have been living together as a family for at least one year. This can be demonstrated with an official cohabitation or partnership document issued in their country of residence. The document must be apostilled or legalized, depending on the requirements applicable to the country where it was issued.

One of the greatest advantages of the Georgian system is that the intended parents are recognized as the child’s legal parents from birth. The surrogate mother has no parental rights over the child.

Birth Certificate Issued Directly to the Intended Parents

Following the birth, the Georgian birth certificate is issued directly in the names of the intended parents. The surrogate mother’s name does not appear on the birth certificate, eliminating the need for court proceedings or post-birth adoption under Georgian law.
